“A law will be enacted in the state by passing the law in the next session of the state legislature on the use of kannada in all areas. We will be the first government to grant legal protection to the Kannada language,” the prime minister said on the day of the foundation in Karnataka. “Every language in India is both a mother tongue and a national language. The motion, filed by lawyer Rakesh B Bhatt, asserts that the rules are ultra vires the Information Technology Act of 2000 because they establish a classification of current news and content publishers and seek to regulate news portals under Part III of the rules. It is said that the introduction of a code of ethics that establishes such vague conditions as “good taste”, “decency”, etc. is not provided for in the parent law (Information Technology Act).
The petition states that the challenge is limited to the 2021 IT rules with respect to the digital news portal and not to publishers of organised online content, i.e. OTT media platforms or other entities that are sought to be regulated by the challenged rules.
